9. ACCOUNT SUSPENSION OR TERMINATION

NELEN reserves the right to suspend or terminate your account if:

• These Terms are violated
• Fraudulent, abusive, or suspicious activity is detected
• Required by law, court order, or regulatory authority
• Payment disputes or chargebacks occur
• Account sharing or credential misuse is detected

Termination under these conditions does not entitle you to any refund.

10. USER RESPONSIBILITY

Users are solely responsible for:

• Ensuring device and software compatibility
• Maintaining a stable and supported internet connection
• Understanding that OTT and IPTV services may change over time
• Keeping login credentials secure and confidential
• All activity that occurs under their account
• Compliance with applicable laws in their jurisdiction

Failure to meet these requirements does not make the service refundable.

11. PRIVACY AND DATA PROTECTION

Your use of NELEN is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using NELEN, you consent to:

• Collection of registration and usage data
• Processing of payment information through secure third-party providers
• Use of cookies and similar technologies for service improvement
• Sharing data with third-party service providers as necessary for service delivery

We are committed to protecting your data in accordance with applicable data protection laws including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.

12. INTELLECTUAL PROPERTY RIGHTS

• The NELEN platform, including its design, logo, trademarks, and interface, is the property of The Bhimavaram Community Network
• All content available through NELEN remains the property of respective content owners
• Users are granted a limited, non-exclusive, non-transferable license to access and use the service for personal, non-commercial purposes only
• This license terminates upon subscription expiry or account termination

13. DEVICE AND CONCURRENT STREAMING LIMITATIONS

• Number of devices and concurrent streams allowed depends on your subscription plan
• NELEN reserves the right to monitor and limit simultaneous streams
• Unauthorized device sharing or exceeding stream limits may result in service restrictions

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• NELEN shall not be liable for indirect, incidental, consequential, or punitive damages
• NELEN is not responsible for loss of data, revenue, profits, or enjoyment
• Use of the service is entirely at your own discretion and risk
• Total liability for any claim shall not exceed the amount paid by you in the last 12 months
• NELEN is not liable for decisions made by third-party content providers

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless NELEN, The Bhimavaram Community Network, and their officers, directors, employees, agents, and affiliates from any claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your misuse of the service
• Your violation of any applicable laws or third-party rights
• Any content you submit or transmit through the service

16. FORCE MAJEURE

NELEN shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

17. RISK AWARENESS AND ACKNOWLEDGMENT

You acknowledge and understand that:

• Content ownership and licensing rights lie with original broadcasters and content providers
• Regulatory changes may impact service availability and features
• IPTV quality and reliability depend on network conditions and infrastructure
• Third-party platform decisions are outside NELEN's control
• Technology and content landscapes are subject to continuous change

18. DISPUTE RESOLUTION

In the event of any dispute arising from these Terms or use of NELEN services:

• Parties agree to first attempt resolution through good faith negotiations
• If unresolved within 30 days, disputes may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996
• The seat of arbitration shall be in Andhra Pradesh, India
• The language of arbitration shall be English
• The arbitration award shall be final and binding upon both parties

19. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to reflect the parties' intention to the extent possible, or if that is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

20. WAIVER

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. NELEN's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

21. ASSIGNMENT

You may not assign or transfer these Terms or your rights and obligations under them without NELEN's prior written consent. NELEN may assign or transfer these Terms or any rights or obligations hereunder, in whole or in part, without restriction and without prior notice to you.

22. MODIFICATIONS TO TERMS

NELEN reserves the right to modify, amend, or update these Terms at any time without prior notice. The latest version published on our website will always apply. Your continued use of NELEN after such modifications indicates your acceptance of the updated Terms. Material changes will be communicated through the platform or via email to your registered email address.

23. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other legal notices or agreements published by NELEN on the platform, constitute the entire agreement between you and NELEN concerning the services and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written.

24. GOVERNING LAW AND JURISDICTION

• These Terms are governed by and construed in accordance with the laws of India
• Courts located in Andhra Pradesh shall have exclusive jurisdiction over any disputes
• Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of Andhra Pradesh
